Conditions d’utilisation

These Terms of Service govern access to and use of ionotix.shop, including purchases made through the website.

By accessing the website or placing an order, customers agree to these Terms to the extent permitted by applicable law.

Nothing in these Terms excludes or restricts mandatory consumer rights.

1. Online Store

ionotix.shop provides an online retail service through the Shopify commerce platform.

References in these Terms to "we," "us," "our," or "the Store" mean ionotix.shop in connection with the operation of this online store.

Customer inquiries may be directed to:

info@ionotix.shop

2. Eligibility

Customers must have the legal capacity required to enter into the relevant purchase contract.

Where a person purchases on behalf of another person or business, that person represents that they have authority to do so.

3. Product Information

We make reasonable efforts to display products and product information accurately.

Product photographs are illustrative and colors may vary depending on screen configuration.

Customers should review product descriptions, dimensions, materials, compatibility information, specifications, and other relevant information before purchasing.

4. Product Availability

All orders are subject to product availability.

Placing an order does not guarantee that stock remains available until the order is accepted and processed.

If an item becomes unavailable after an order has been submitted, we may contact the customer and provide an appropriate solution, including cancellation and refund where required.

5. Prices

Prices are displayed on the website in the currency indicated during shopping and checkout.

Applicable taxes and mandatory charges will be handled in accordance with the information displayed to the customer and applicable law.

Before confirming an online purchase, French consumers must be given clear information concerning the essential characteristics and total price of their order.

6. Pricing Errors

We may correct genuine typographical, technical, or pricing errors.

If a material pricing error affects an order already submitted, we may contact the customer before fulfillment.

Any cancellation or correction will be handled subject to applicable consumer law.

7. Orders

An order is submitted when the customer completes the checkout procedure and confirms the payment obligation.

Customers are responsible for checking:

  • Products selected;
  • Quantities;
  • Delivery information;
  • Billing information;
  • Contact information;
  • Total amount payable.

French e-commerce rules require customers to have an opportunity to review and correct order information before final confirmation.

8. Order Acceptance

An automated order confirmation acknowledges receipt of an order but does not necessarily mean that every aspect of the order has been finally accepted for fulfillment.

We may refuse or cancel an order where permitted by law, including in cases involving:

  • Suspected fraud;
  • Unauthorized payment;
  • Material pricing errors;
  • Product unavailability;
  • Invalid delivery information;
  • Legal restrictions.

Where a paid order is lawfully cancelled, the appropriate amount will be refunded.

9. Payment

Customers agree to provide valid and accurate payment information.

Payment processing may be handled by Shopify and third-party payment processors.

The payment methods available to a customer are displayed at checkout.

10. Shipping

All orders are eligible for free standard shipping under our current Shipping Policy.

The expected standard delivery timeframe is 15 to 20 calendar days, unless another timeframe is clearly communicated before purchase.

Delivery terms are described in detail in our Shipping Policy.

11. Delivery Information

Customers must provide an accurate and complete delivery address.

We are not responsible for delays resulting solely from materially incorrect or incomplete address information supplied by the customer, except to the extent responsibility cannot legally be excluded.

Customers should contact us promptly if they discover an address error.

12. Right of Withdrawal

Consumers purchasing at a distance in France generally have a 14-day statutory withdrawal period for qualifying purchases, subject to legal exceptions.

Detailed withdrawal procedures are set out in our Return and Refund Policy.

13. Returns and Refunds

Returns and refunds are governed by our Return and Refund Policy.

Nothing in a voluntary commercial return policy restricts mandatory statutory rights.

14. Legal Guarantee of Conformity

French consumers may benefit from the statutory legal guarantee of conformity for qualifying goods.

For covered products, a lack of conformity may generally be invoked where it appears during the statutory two-year period following delivery, subject to the applicable legal rules.

These statutory rights are separate from any voluntary commercial guarantee.

15. Hidden Defects

Consumers may also have rights relating to hidden defects under applicable French law.

The legal guarantee against hidden defects operates independently from commercial warranties and the legal guarantee of conformity.

16. Promotions and Discount Codes

Discount codes and promotions may be subject to conditions including:

  • Validity dates;
  • Minimum order values;
  • Product exclusions;
  • Single-use restrictions;
  • Non-combinability with other promotions.

Specific promotional conditions displayed at the time of an offer form part of that offer.

17. Intellectual Property

Website materials, including original text, graphics, logos, layout, product presentation, and other content, may be protected by intellectual-property laws.

Customers may use the website for personal shopping purposes.

Unauthorized commercial copying, reproduction, distribution, scraping, or exploitation of protected content is prohibited except where permitted by law.

18. Prohibited Use

Users must not use the website:

  • For unlawful purposes;
  • To commit fraud;
  • To interfere with store security;
  • To introduce malicious software;
  • To attempt unauthorized access;
  • To impersonate another person;
  • To misuse payment systems;
  • To violate intellectual-property rights;
  • To interfere with another person's lawful use of the website.

19. Third-Party Services

Certain store functions may depend on third-party providers such as Shopify, payment processors, shipping carriers, analytics providers, or other technology services.

Third-party services may be subject to their own terms and privacy practices.

20. Website Availability

We aim to keep the website available but cannot guarantee uninterrupted operation at all times.

Maintenance, technical errors, infrastructure problems, security incidents, or circumstances beyond reasonable control may temporarily affect availability.

Nothing in this section limits liability that cannot legally be excluded.

21. Accuracy of Website Information

We may update website content periodically.

If we discover a material error affecting an existing customer order, we will take reasonable steps to inform the customer and handle the matter consistently with applicable law.

22. Limitation of Liability

Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by law.

In particular, these Terms do not remove mandatory consumer rights relating to defective goods, non-conforming goods, statutory withdrawal rights, personal injury caused by legally actionable conduct, fraud, or other liability that cannot lawfully be excluded.

23. Privacy

Use of personal information is governed by our Privacy Policy.

Customers should review the Privacy Policy before submitting personal information.

24. Consumer Complaints

Customers should first contact:

info@ionotix.shop

Please include the order number and a description of the issue.

We will make reasonable efforts to resolve legitimate complaints amicably.

25. Consumer Mediation

French consumer law requires qualifying professionals to provide consumers with details of the consumer mediator with whom the professional is affiliated. A mediator must be properly referenced for the relevant activity.

The operator of ionotix.shop must therefore publish the details of its actually appointed mediator once that mediator has been selected or contracted. No mediator has been named in these Terms because no such information was supplied and it would be inappropriate to invent an affiliation.

26. Governing Law

These Terms are governed by applicable French law in relation to customers in France, subject to any mandatory protections that cannot legally be waived.

Nothing in these Terms deprives a consumer of mandatory protections available under applicable consumer legislation.

27. Dispute Resolution

We encourage customers to contact us before initiating formal proceedings.

Any dispute that cannot be resolved amicably may be referred to the legally competent court or an applicable consumer dispute-resolution procedure.

These Terms do not impose an exclusive jurisdiction clause where doing so would unlawfully restrict a consumer's rights.

28. Severability

If a provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue to apply to the fullest extent permitted by law.

29. No Waiver

Failure to enforce a contractual right immediately does not automatically constitute a permanent waiver of that right.

30. Changes to These Terms

We may update these Terms where reasonably necessary.

Changes apply prospectively unless applicable law permits or requires otherwise.

The current version will be published on ionotix.shop with an updated revision date.
